By accessing or using Indian Tenant (www.indiantenant.com), operated by Indian Tenant Technologies, you agree to be bound by these Terms and Conditions. This is a legally binding agreement. If you do not agree, please do not use our platform.

1. Definitions

• "Platform" – The Indian Tenant website (www.indiantenant.com) and all associated services.
• "User" – Any registered or unregistered person accessing the platform.
• "Property Seeker" – A user who searches for or views properties.
• "Property Owner / Agent" – A user who lists properties on the platform.
• "Subscription" – A paid plan that grants view credits to Property Seekers.
• "Transaction" – Any payment made by you on the platform for a subscription or service.
• "Payment Gateway" – Razorpay Software Private Limited, our authorised payment processing partner.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under applicable Indian law to use this platform. By using the platform, you represent and warrant that you meet this eligibility requirement.

3. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• Notify us immediately of any unauthorized access to your account.
• One person may not maintain multiple accounts.
• We reserve the right to suspend or terminate accounts where false or incomplete information is provided.

4. Property Listings

• All property information submitted must be accurate, current, and lawful.
• You must have the legal right or authority to list a property.
• Fraudulent, duplicate, or misleading listings will be removed and the account may be suspended.
• Indian Tenant reserves the right to approve, reject, or remove any listing without prior notice.
• Images uploaded must be original and relevant. Obscene or copyrighted images are prohibited.
• You agree to indemnify Indian Tenant against any claims arising from property listings you submit.

5. Subscription & Payments

• Accessing property detail pages requires an active subscription with sufficient view credits.
• All payments are processed securely through Razorpay Software Private Limited. By making a payment, you also agree to Razorpay's Terms of Service.
• View credits are non-transferable, non-refundable once consumed, and expire as per the plan terms.
• Indian Tenant reserves the right to modify subscription pricing with reasonable prior notice.
• You are responsible for providing accurate payment information. We do not store your card or bank account details; all such data is handled by Razorpay in compliance with PCI-DSS standards.
• In the event of a payment failure where an amount is deducted, Razorpay typically initiates an auto-refund within 5–7 business days. If not received, please contact us or Razorpay support.
• You are responsible for reconciling your transactions. Disputes regarding billing must be raised within 7 days of the transaction date.
• Any convenience fee displayed at checkout is inclusive in the transaction amount and is non-refundable.

6. Chargebacks & Disputes

• If you initiate a chargeback through your bank for a transaction on this platform, we reserve the right to suspend your account pending investigation.
• You must raise any payment dispute with us first by emailing indiantenant@gmail.com before filing a chargeback.
• For disputed transactions, you may be asked to provide supporting documents within 3 calendar days of notification.
• Chargeback disputes will be resolved in accordance with applicable RBI guidelines and the rules of the relevant card payment network (Visa, Mastercard, RuPay, etc.).

7. Prohibited Conduct

You shall not use the platform to:

• Post false, misleading, or fraudulent property information.
• Engage in spam, phishing, or any unlawful activity.
• Attempt to gain unauthorized access to our systems.
• Scrape, crawl, or automate data extraction from the platform.
• Share account credentials or view credits with others.
• Facilitate any transaction that violates applicable Indian law, including but not limited to the IT Act 2000, PMLA 2002, or RBI regulations.
• Impersonate any person or entity.
• Upload, transmit, or distribute any unlawful, threatening, defamatory, obscene, or pornographic content.
• Use the platform for virtual currency, cryptocurrency, gambling, or any activity prohibited under Section 17 of Razorpay's Payment Aggregator terms.

8. User Communications & Marketing Consent

By registering on our platform and providing your contact information, you consent to receiving transactional messages, OTPs, account notifications, and promotional communications via email, SMS, and WhatsApp. If you wish to opt out of marketing communications, you may unsubscribe via the link in our emails or contact us. Opting out applies prospectively and does not affect previously consented communications.

9. KYC & Verification

We may require you to complete KYC (Know Your Customer) verification as mandated under applicable laws or by our payment partner Razorpay. Failure to provide required KYC documents may result in suspension of services. You consent to us sharing KYC information with Razorpay, banks, and regulatory authorities as required by law.

10. Intellectual Property

All content on Indian Tenant — including logos, design, text, software, and code — is the property of Indian Tenant Technologies or its licensors. You may not reproduce, distribute, or create derivative works without prior written permission. All trademarks and service marks remain the property of their respective owners.

11. Disclaimer of Warranties

Indian Tenant is a property listing platform and does not verify the accuracy of listings, conduct property inspections, or guarantee any transaction. All dealings between users are at their own risk. We are not a party to any property transaction. The platform is provided on an "as is" basis without any warranty of uninterrupted or error-free service.

12. Limitation of Liability

To the maximum extent permitted by law, Indian Tenant Technologies and its officers, directors, and employees shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages (including loss of profits, data, or goodwill) arising from your use of the platform. Our aggregate liability for any claim shall not exceed the amount paid by you in the three months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Indian Tenant Technologies and its officers, directors, employees, and agents from and against all claims, liabilities, losses, damages, fines, and expenses (including legal fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any applicable law; (c) your use of the platform; or (d) any content you submit to the platform.

14. Grievance Redressal

We will acknowledge your complaint within 48 hours and endeavour to resolve it within 5 business days. For payment-related grievances involving Razorpay, you may also contact Razorpay's Nodal Officer at razorpay.com/grievances.

15. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms without prior notice. Upon termination, your right to use the platform ceases immediately, and any unused view credits will be forfeited. Termination does not relieve you of obligations incurred prior to termination.

16. Data Retention

Transaction records are retained for a minimum period of 10 years from the date of transaction as required under applicable laws and payment gateway guidelines. Account data is retained as described in our Privacy Policy.

17. Amendments

Indian Tenant reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Your continued use of the platform after any amendment constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Pune, Maharashtra. In relation to payment disputes involving Razorpay, such disputes shall be governed per the Razorpay Terms of Service and RBI guidelines.
